I understand what you mean, but sadly there is not much that can be done.
I recommend you pm the user politely asking but there is no rule against it and I can only suggest with future avatars, you have your name on them so they can't be copied quite as easily.

There is no way to moderate and putting restrictions on avatars would be impossible ( we can't expect people to search through every single member and make sure an avatar isn't already being used ).

An avatar is just an image, someone copies .. let 'em, nothing to get angry over bro. As I've said before, there's more important things in life to worry about.
