Would that person be able to release a music album under that name? Or would that person also have to include their last name to not get into any legal trouble?

Yeah, they'd have to differentiate from just Eminem. I'm no lawyer, but that's what my basic law class taught me.

That wasn't a legal issue, just a good marketing move.
