Upshaw, the lawyer for the suspected killer of Proof -

Upshaw gave this account of the shooting, based on witnesses he has questioned:

Proof and Bender were playing pool, and Proof was losing. Words were exchanged, and Proof grabbed Bender by the face, shoved him and then hit him. As Bender tried to defend himself, Proof pulled a handgun and "pistol whipped" Bender, then shot him in the temple.

"As Proof stood over him with the weapon, someone came to Mr. Bender's aid and someone shot Proof," Upshaw said.

yeh i agree it looks pretty biased. i also heard proof's lawyers basically say the exact opposite -

"To indicate that Proof pulled the trigger first is reckless and quite frankly it will be proved to be untrue," attorney David Gorosh said Thursday.v

"It's disingenuous to speak to the media to try and suggest that Proof shot first. There are ways to determine what shots were fired and by whom," he said. "There's an ongoing investigation."

"Until all of the factual evidence has been evaluated, an opinion by the Detroit Police Department is premature."

im just gonna wait till thing goes to court....people seem not eager to find out that maybe proof started the fight....yall gotta remember that this cat was 100% pure street at heart.If he had beef with the guy and had the need to pull out his gun then so be it.

yer shit would always be available to those set on owning a piece.Plus would give them more reason to go underground for shit and go round with unlicensed guns....i know they do already btu would drive it up more.....

theres no way to stop gun violence....shits been happening since the invention of guns....i guess u can only look for people to realise there is no status in owning a piece.Any hood cat knows you have two leathal weapons attached to the end of your arm.

Any fool with a index finger can pull a trigger.

Yeah. If there was no guns this prolly wouldn't of happened, cos not as many people would have a gun. Just about everyone in the U.S has a gun, and this is why it's bad.


totally agree. i fink we wud still have pac, big, jay, proof.... all of dem if guns were banned liked dey r in the uk. insted of guns it would be fists, instead of death it wud be a a black eye.

update - he has not been charged with murder

A man was charged Friday with weapons violations in a shooting earlier this week that took the life of hip-hop artist Proof, a close friend of Eminem.

Mario Etheridge, 28, of Detroit, was charged Friday with carrying a concealed weapon and discharge of a firearm in a building, according to the Wayne County prosecutor's office.

"Our investigation in this case is far from over," Prosecutor Kym Worthy said in a statement.

Assistant prosecutor Maria Miller said that without the weapons charges, authorities would have had to release Etheridge from custody. But she would not comment when asked if more charges are possible.

"Our investigation into the death of Proof continues. There can't be any conclusions about anything until that investigation is completed," she said.

Etheridge will be arraigned Saturday in 36th District Court in Detroit. He has been held by police since he surrendered Wednesday afternoon; his attorney has said the shooting was in self-defense and Etheridge should not be charged.

If convicted, Etheridge faces a maximum of five years in prison on the concealed weapon charge and four years on the discharging a firearm count.

Detroit police said they were told by witnesses that Etheridge shot Proof early Tuesday after Proof shot Army veteran Keith Bender, 35, inside the CCC, a nightclub in a strip of businesses along Eight Mile Road.

Bender remained in critical condition Friday with a gunshot wound to the head.

Etheridge's lawyer, Randall Upshaw, said they will fight the charges. He would not say whether his client fired the gun.

"If anyone discharged the weapon, it was in defense of others or themselves," he said. "If it takes discharging a weapon to save a life, then I find it disturbing that you would be charged with discharging a weapon."

Upshaw said the charges give police a reason to hold Etheridge while they investigate.

A message was left Friday for Proof's lawyer, David J. Gorosh, who previously has said that the police investigation will clear the rapper's name.

Proof's funeral will be held on Wednesday, said Khalid el-Hakim, vice president of Iron Fist Records, Proof's record label.
