The man who is believed to have fatally shot the rapper Proof waived his preliminary examination Wednesday on firearms charges, sending the felony case to Wayne Circuit Court for a trial. Mario Etheridge, 28, is charged with carrying a concealed weapon and discharging a firearm in an occupied building. He is not charged with Proof's death, though Wayne County Prosecutor Kym Worthy has not ended her inquiry on the April 11 shooting at the C.C.C. nightclub on Eight Mile in Detroit.
Etheridge's lawyer, Randall Upshaw, has said his client prevented Proof, whose real name was Deshaun Holton, from hurting others.
Etheridge "grabbed a gun to stop someone from killing someone else," he said following last week's arraignment. "He's not guilty."
Etheridge, a bouncer, is the cousin of Keith Bender Jr., who, police say, was shot in the head by Proof. Bender, a U.S. Army veteran, died a week after the shooting. His funeral is scheduled for Thursday.
The Michigan Liquor Control Commission is scheduled to hold a hearing today to determine what, if any, action to take against the private club after police said they found several underage drinkers at the club, operating after hours, in a December raid.
The commission has also received separate complaints for the Proof shooting incident and for another shooting days before that.
