They both came up with it on their own...Tech N9ne did it first.

My point is that it doesn't matter who came up with it first because we're all plucking from the same bag of words and the final products are completely unrelated. With the amount of verses written/recorded each day, by every prominent rapper, this is inevitable. But know that there is a fine line between inevitable and intentional.

Of course Em's lyrics have been bit before, but the true examples have already been argued into the ground here. The only examples left to post are simple coincidences and you're trying to lynch people for it (not you, amadeo). And if it's not that, people are freaking out over obvious homage (like the post directly above this)

I imagine it's often unintentional and subconscious.

If I'm trying to think of something to rhyme with 'work a sweat' a bunch of examples from Rock Bottom are going to spring to mind.

I may even think I legitimately thought up 'deserve respect'
or even variations of the options--say 'reverse respect'.

It's not that they need his lyrics to write their own. The reason is different for each case. Take the Justice case for instance:

1. He thinks of a punchline on the spot to mock his opponent using props and handwritten signs. "You ain't freestyling if you have to use props."

2. He thinks of a whole bunch of things that rhyme with "use props" to set it up. He thinks of boob job, and then remembers that rhymes with Snoop Dogg because he's seen 8 Mile.

Organik did it freestyling too (seemingly). For all the other written cases, it's usually just the rapper getting lazy and deciding to borrow an Eminem rhyme, hoping nobody will notice.

It isn't something to lose sleep over, and you wouldn't take them to court for intellectual property theft...it's just lazy.

Elision's argument is that it's probable Justice thought of boob job/Snoop Dogg independently.

Regardless if he's recalling a rhyme.

Role Model was made in 98, and he used the first verse as a freestyle before SSLP even dropped.
